These Terms and Conditions (“Terms”) govern your use of this website and any quotation, order, or sale of products by Agriculture89 Anon Limited, registered in Thailand (“we”, “us”, “our”). By accessing this website or placing an enquiry or order, you agree to these Terms.

Products and Quotations

Product listings and specifications on this website are provided for general information and do not constitute a binding offer. Prices are not displayed online; all pricing is provided by written quotation on request. Product specifications, grades, and availability are indicative and are confirmed at the time of quotation. Images are illustrative.

Orders and Contracts

An enquiry or purchase order does not create a binding contract until we issue a written order confirmation or sales contract. Minimum order quantities are flexible and confirmed per product. Quotations are valid for the period stated in the quotation and are subject to availability.

Pricing and Payment

Prices are quoted per order and are exclusive of duties, taxes, and charges levied at the destination unless expressly stated. Payment terms are agreed in writing for each order. We reserve the right to require payment or security before commencing production or shipment.

Delivery

Delivery terms, Incoterms, and lead times are set out in the applicable quotation or contract and in our Shipping & Export Policy. Estimated lead times are given in good faith and are not guaranteed dates.

Quality and Inspection

Our products are processed and packed under GMP, HACCP, and ISO-certified standards. Buyers are responsible for confirming that products meet the import and food-safety requirements of their destination market. Pre-shipment inspection by the buyer or an independent agency is welcome and may be arranged by agreement.

Intellectual Property

All content on this website, including text, graphics, logos, and images, is owned by or licensed to us and may not be reproduced without our written permission.

Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of or in connection with any order shall not exceed the value of the products giving rise to the claim. We shall not be liable for any indirect, incidental, or consequential loss, including loss of profit or business.

Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including but not limited to natural disasters, crop failures, port or transport disruption, strikes, government action, or changes in export or import regulations.

Governing Law and Dispute Resolution

These Terms and any contract of sale are governed by the laws of Thailand. Any dispute arising out of or in connection with them shall be referred to and finally resolved by arbitration with the seat of arbitration in Thailand, in accordance with applicable arbitration rules, before resorting to litigation.
